When using the Services, you may view information and content owned, licensed or provided by SIA Breaths Easy, its branches and affiliated companies (“Dopamine Lab Baltics”). The Services may also include information provided by third parties and distributed under a license, permission or other agreement with Dopamine Lab Baltics. In this Privacy Policy, “we” and related forms refer to Dopamine Lab Baltics.

Use of the Services and provision of information

At times, you may choose to provide us with personally identifiable information. For example, you may wish to register, make purchases, read articles and view information, receive emails from us, receive invitations to events, participate in discussions, preview new services or take part in special promotions. If you register to use the Services or conduct transactions through the website dopaminelabbaltics.lv or a Dopamine Lab Baltics mobile application, we will collect information about your transactions and other activities. We need certain information from you to register and authenticate you where necessary, process your entries and payments, and send you goods.

Accordingly, providing us with your personal data is voluntary. However, if you do not provide it, we will be unable to achieve the purposes stated in this Privacy Policy. Where your personal data is processed on the basis of your consent, you may withdraw your consent to the processing of personal data at any time, but this will not affect the lawfulness of processing carried out before the withdrawal.

Scope, purposes and duration of personal data processing

We may collect information that you voluntarily provide to us, as well as website visit data, as described below.

Personally identifiable information you provide

Personally identifiable information includes your first name, last name, email address, telephone number, date of birth, delivery and billing addresses, and a persistent identifier associated with personally identifiable information, as well as other information you may voluntarily provide to us. We collect such personally identifiable information from you for the following personal data processing purposes:

1. Administration of registration and membership in the Dopamine Lab Baltics Loyalty Program

We process your personal data to register you for the Dopamine Lab Baltics Loyalty Program and administer your membership. Membership in the Dopamine Lab Baltics Loyalty Program can be used to place orders in the Dopamine Lab Baltics online store, receive personalized offers, a regular discount, commercial information about news, and enjoy other program benefits both in the Dopamine Lab Baltics online store and in physical stores.

Your data will be used to create or access your Dopamine Lab Baltics account and display relevant information in it, respond to your requests, ensure that your information is accurate and up to date, verify your registration, and contact you when we need to reach you and provide necessary information, for example, about changes to the Dopamine Lab Baltics Loyalty Program terms.

To enable us to create your account and manage your membership, you must provide the personal data necessary to enter into and perform the contract; otherwise, registration for the Dopamine Lab Baltics Loyalty Program is not possible. Registration requires your first name, last name and email address.

The retention period for personal data depends on the activity of your Member account. If it remains inactive for two consecutive calendar years, the personal data will be deleted or irreversibly anonymized.

The legal basis for processing personal data is to enter into and perform a contract with you.

2. Management of personalized offers and other benefits

As part of your membership, we process your personal data to administer personalized offers and other benefits, such as birthday benefits. We process only the personal data necessary for the particular benefit.

We use automated decision-making, including profiling, to provide you with personalized offers and other benefits. To do so, we may analyze the personal data you provide and data we obtain based on your behavior (e.g., your shopping transactions and activity in your Member account), using general rules or specific algorithms and predictive models. Our activities do not produce any legal or similarly significant effects on you.

To provide you with basic benefits, we use automated decision-making based solely on general rules that apply to all customers who are members of the Dopamine Lab Baltics Loyalty Program. It is not based on your preferences, behavior or similar attributes, and we do not assess any aspects of your behavior or preferences to provide these benefits. For example, based on the date of birth you enter, the system determines when birthday benefits apply to you. Based on which benefits you use or do not use, we may determine other benefits available to you that we offer.

To offer you personalized offers and recommendations (and sometimes other benefits), we need to profile you, i.e., use special algorithms and predictive models to analyze your choices, behavior or similar attributes. For example, special algorithms analyze the personal data you provide and your shopping transactions (such as products purchased) to develop personalized offers tailored to you. Based on your shopping transactions, we may also create personalized recommendations for you about other benefits we offer that are available to you.

Because personalized offers and benefits are the essence and primary purpose of membership, you cannot be a member if you do not want automated decisions to be made about you or profiling to be carried out.

Managing personalized offers and other benefits requires your first name, last name, date of birth, purchase history, user-generated personal data, such as information about activity in information systems (including the Dopamine Lab Baltics online store).

The retention period for personal data depends on the activity of your Member account. If it remains inactive for two consecutive calendar years, the personal data will be deleted or irreversibly anonymized.

The legal basis for processing personal data is to enter into and perform a contract with you.

3. Administration of purchases in the Dopamine Lab Baltics online store

We process your personal data to manage your purchases in the Dopamine Lab Baltics online store. Your personal data is processed to handle your order and payment, send an invoice, contact you about your order and its status, deliver your order, and perform similar activities related to fulfilling the order.

To fulfill your order, you must provide the personal data necessary to enter into and perform the contract. For example, to pay for an order, you must provide payment details; if you want home delivery, we need to know the address to which the order should be delivered.

You do not need to create an account to place orders in the Dopamine Lab Baltics online store. You can also place an order as a guest, providing only the personal data necessary to place the order, such as your first name, last name, contact details and payment information.

We use your mobile phone number and email address to contact you about an order you have placed. For example, we may contact you if there are problems with your orders or with delivery to your address, or to inform you of your order status (order confirmed, ready for delivery, delivered, canceled, unfulfilled, available for collection after an unsuccessful delivery attempt, etc.).

To deliver an order, Dopamine Lab Baltics may use outsourced services or offer the services of other delivery companies. In this case, limited personal data may be shared with Dopamine Lab Baltics partners acting as separate data processors or controllers. For example, your personal details, contact details, and order and delivery information. If information is shared with another data controller, Dopamine Lab Baltics will provide a link to that controller’s privacy policy.

Administering purchases in the Dopamine Lab Baltics online store requires your first name, last name, all types of contact details, and information about the order, payment, transaction and delivery.

The retention period for personal data depends on the activity of your Member account. If it remains inactive for two consecutive calendar years, the personal data will be deleted or irreversibly anonymized. Order-related documentation will be retained in accordance with national law for 10 years from the date the order was placed.

The legal basis for processing personal data is to enter into and perform a contract with you.

4. Compliance with legal requirements

We process your personal data to comply with various legal requirements that apply to us, such as accounting requirements, product liability and product safety. For example, we retain transaction information and documentation relating to your Dopamine Lab Baltics online store order (e.g., order details, invoices and return details) for the period required by law.

Compliance with legal requirements requires your first name, last name, all types of contact details, and information about the order, payment, transaction and delivery.

Order-related documentation will be retained in accordance with national law for 10 years from the date the order was placed. Other information relating to compliance with legal requirements will be retained for the periods specified by law.

The legal basis for processing personal data is compliance with legal obligations.

5. Management of customer claims, complaints and suggestions

We process your personal data to handle your claims, complaints, suggestions and other inquiries, including reviews of our products in the online store.

If you submit a claim, please also provide the following information: your first name, last name, contact details, a description of the claim and documents supporting your claim. If you do not provide this information, we will be unable to assess and resolve your claim. When handling a customer claim or complaint, other categories of personal data mentioned in this Privacy Policy may also be processed.

All personal data relating to claims, complaints or suggestions that have been reviewed is retained for no longer than two years from the date of receipt. Personal data may be retained longer if a claim or complaint has not yet been resolved or legal proceedings are ongoing. In that case, personal data is retained until the matter is resolved or for one year after the relevant legal proceedings conclude. Product reviews are retained for as long as the product is available in the online store.

The legal basis for processing personal data is that processing is necessary to comply with a legal obligation applicable to us concerning the handling of claims and complaints.

For product reviews in the online store, the legal basis is that processing is necessary for our legitimate interest in receiving customer feedback to improve the shopping experience.

6. Surveys

We may process your personal data to invite you to participate in surveys and collect customer feedback to improve and expand our services. If you have consented to receive marketing information, we may send a survey through your chosen communication channel. In other cases, we may publish our survey on our website or in our online or physical stores, where you can access it and participate if you wish.
Participation in surveys is voluntary.

Surveys are anonymous unless participation in a survey is organized together with entry into a prize draw.

To enable you to participate in a survey that is not anonymous, we may need your first name, last name, contact details, purchase history, feedback and opinions.

Survey data is retained for up to one year after the prize draw ends.

The legal basis for participation in a survey is your consent.

7. Lotteries

We process your personal data to administer lotteries, games and/or competitions organized by Dopamine Lab Baltics or its suppliers if you have expressed a wish to participate in them. We process your personal data to determine and announce the winner, identify you when awarding prizes, and include your first and last name in the lottery record as required by law.

If you wish to participate in a lottery, game and/or competition, you must provide us with your personal data. If you do not provide your personal data, you will not be able to participate or, if you win, we will not be able to award you the prize.

When a prize is awarded, your identity will be verified, and the award will be canceled if there are discrepancies.

A lottery may require your first name, last name, contact details, purchase history and user-generated personal data, such as information about activity in the Dopamine Lab Baltics online store.

If you are a winner, your first and last name will be included in the prize receipt and the lottery, game or competition record, which will be retained for five years from the date of the lottery, game or competition. In all other cases, personal data obtained during a lottery, game or competition will be retained for no longer than two years from the date it ends.

The legal bases for processing personal data for lottery purposes are your consent and our legal obligation to prepare a lottery record/award the prize.

8. Sending commercial communications

We process your personal data to send you marketing information, such as personalized offers, information about discounts, benefits, sales, special campaigns, our news, events and new products in our range, through your chosen communication channel, such as SMS, email or browser notifications. You may also register solely to receive commercial communications about news without joining the Dopamine Lab Baltics Loyalty Program.

We use automated decision-making, including profiling, to provide personalized and effective direct marketing communications to you. To do so, we take into account the personal data you provide and data we obtain based on your behavior. Our activities do not produce any legal or similarly significant effects on you.

You may opt out of the commercial or direct marketing communications we send you at any time. You can do so by emailing [email protected] or using the unsubscribe link in an email sent to you.

If you opt out of direct marketing communications, we will update your personal data processing settings so that you no longer receive them.

Sending commercial communications may require your first name, last name, date of birth, all types of contact details, information about benefits used, purchase history, customer preference data (such as consents given), user-generated personal data (such as an abandoned shopping cart), and connection information (such as the type of device used).

Data for sending commercial communications will be processed until you withdraw your consent to receive them.

The legal basis for processing personal data for commercial communications is your consent.

9. Information security, fraud prevention and management of legal claims

We may process your personal data to establish, exercise and defend legal claims, including to prevent and/or stop fraudulent or unlawful activities, gather evidence of identified issues and manage the situation, and prevent misuse of our products or services.

Fraud prevention and management of legal claims may require any information and personal data mentioned in this Privacy Policy that you have previously provided to Dopamine Lab Baltics.

In the event of legal claims, data will be processed while an investigation, settlement or legal claim is ongoing. Data will be retained for three years after a decision to close the investigation or until the final enforcement of a court judgment.

Data such as audit logs are retained for information security purposes for up to 18 calendar months, unless the law requires a longer retention period.

Processing is necessary for our legitimate interests in establishing, exercising or defending legal claims and ensuring information security.

10. Statistical and market research purposes

We process your personal data for statistical purposes so that we can monitor, evaluate, improve and expand our online services. For these purposes, we will not process your name, contact details or any other directly identifying information that could identify you as a specific person.

Statistical and market research purposes may require information about a member’s participation in the Dopamine Lab Baltics Loyalty Program (such as duration and year of registration), information about orders, deliveries, payments, purchase history, customer preferences, user activity within the Dopamine Lab Baltics Loyalty Program and feedback.

Data for statistical and market research purposes will be retained for as long as necessary to pursue our legitimate interests.

The legal basis for processing personal data for statistical and market research purposes is that processing is necessary for our legitimate interests in improving and expanding our services.

To protect your privacy and security, we will take appropriate measures to verify your identity, such as requesting a password and user ID before granting access to your data. We strive to protect users’ personal information and privacy, but we cannot guarantee the security of any information you disclose online, and you do so at your own risk.

Terms and Conditions

Latvian law requires online store owners to specify the terms for delivery and return of goods, as well as the right of withdrawal. These terms are set out in a distance contract (Cabinet regulations).

Distance contract

The seller of the goods offered in this online store, hereinafter referred to as the Seller, on the one hand, and the person placing an order, hereinafter referred to as the Buyer, on the other hand, enter into the following Agreement:

The Seller undertakes to sell and deliver goods to the Buyer in accordance with the Buyer's order.

Delivery and payment

The Buyer orders goods through this website, specifying the type and quantity of goods ordered. The Buyer may pay for the goods using the payment tools integrated into the online store or by paying the invoice prepared by the Seller for the order and sent to the Buyer by email. The invoice is prepared electronically and is valid without a signature.

The Seller delivers the goods within 3–10 business days of receiving payment for them.

Data processing

By entering the required information when placing an order, the Buyer confirms that they have read and agree that the data they provide will be used so that the Seller can accept the Buyer's order and deliver the goods in accordance with the requirements of Latvian law. By entering this information, the Buyer agrees to receive notifications related to the processing of their order at the email address provided.

Returns

All goods purchased from the dopaminelabbaltics.lv online store are covered by a warranty, and buyers have the right of withdrawal under Latvian law. When shopping online, buyers have the right to return goods within 14 calendar days of receiving them (Cabinet of Ministers Regulation No. 207, “Regulations on Distance Contracts”).

RETURNING GOODS:

  • The Buyer must inform us of their intention to return goods within 14 days of receiving them by emailing the online store at [email protected] or calling +371 29638550.
  • A withdrawal can be requested only upon presentation of proof of purchase (a receipt, invoice, delivery note or payment receipt). Returned goods must be in their original, undamaged packaging.
  • Section 12, Paragraph six of the Consumer Rights Protection Law of the Republic of Latvia states that “the consumer is responsible for preserving the quality and safety of the goods while exercising the right of withdrawal”.
  • SIA Breaths Easy reserves the right to deny the Buyer the right of withdrawal or withhold compensation if the goods are damaged. Products cannot be returned if the original packaging has been opened or damaged.
  • In the event of a return, the Buyer bears the delivery costs, except when the reason for the return is that the goods do not match the order or are defective.
  • Goods purchased at a discount cannot be returned, but they can be exchanged for another product or a gift card of equal value.
  • SIA Breaths Easy guarantees a refund to the Buyer as soon as possible after receiving the returned package, but no later than 10 calendar days thereafter.

What are cookies?

Cookies are small text files that your browser stores on your device (such as a computer, mobile phone, or tablet) when you browse websites. They are widely used to make websites work or work better and more efficiently.

The law states that we may store cookies on your device if they are strictly necessary for this website to function. For all other types of cookies, we need your permission.

This website uses different types of cookies. Some cookies are placed as a result of third-party services available on our pages.

Our cookies help us:

  • Ensure that the website works as you expect.
  • Keep your session active while you visit the website for your convenience.
  • Remember your settings during and between visits.
  • Improve the website's speed and security.
  • Customize our website when you are logged in to help you find the information you need faster.
  • Continuously improve our website to meet your needs.
  • Make our marketing more effective (thereby helping us offer you more relevant marketing content).

Your consent

When you access our website, a banner will appear with a link to the Cookie Policy and three options:

  • Allow all – allows our website to set all cookies.
  • Customize – allows you to choose whether to accept certain types of cookies.
  • Reject – allows you to reject all cookies except those that are necessary.

Generally, the more cookies you allow, the better your experience will be. However, for privacy reasons, you do not have to consent to cookies unless they are necessary.

You can see exactly which cookies we use, their names and categories, purposes, and retention periods on our websites in our cookie banner. You can reopen the banner even after closing it by clicking the “Cookie Settings” button at the bottom of our website. This also allows you to control your cookie preferences.

The banner will also provide information about retention periods, the third parties involved, and descriptions of specific cookies.

Types of cookies

Cookies are generally categorized by retention period, party, and purpose. Remember that a cookie can fall into each of these categories at the same time; for example, it may be a persistent functionality cookie set by a third party.  Below you will find detailed information about the types of cookies we use. Information about specific cookies can be found in the updated website cookie banner, which you can open at any time by clicking the “Cookie Settings” button at the bottom of our website.

We use two types of cookies, also known as “session” and “persistent” cookies. This categorization helps determine and apply retention periods for the cookies placed.

Session cookies

A session cookie is used each time you visit our website. We use this type of cookie to link your activities on our website, but each session cookie works only during a single browser session and expires when that session ends. Each browser session begins when you open a browser window and ends when you close it. After your visit to our website, all session cookies are deleted.

Persistent cookies

A persistent cookie allows your preferences or activities on a website (or across different websites) to be remembered. It lasts longer than a session cookie and remains active for the period specified in the cookie (which varies by cookie). This type of cookie is not deleted when you close your browser window and is stored on your device. It will be activated each time you visit the website where that particular persistent cookie was created.

We use two categories of cookies, also known as “first-party” and “third-party” cookies. This categorization helps identify who else will have access to the information collected by a cookie.

First-party cookies

First-party cookies are created on our behalf by our authorized service providers. These cookies help provide you with a better experience and keep your session open. For example, your browser can remember key information, such as which products you add to your shopping cart, your username, and your language preferences. A first-party cookie can be read only when you visit our domain.

Third-party cookies

A third-party cookie is created by a company other than us. We sometimes use such cookies or other tracking mechanisms by incorporating products offered by third parties into our website to collect the performance data we need, gather data for marketing purposes, provide social sharing functionality, and so on. In such cases, these third parties also receive information from these cookies or other tracking mechanisms and may use it for their own purposes, including collecting more information than we have requested for our purposes.

In our website's cookie banner, we describe the purposes for which we use such cookies or other tracking mechanisms. However, the activities and purposes for which these third parties may use information obtained through these cookies or tracking mechanisms depend on their privacy policies. We recommend reviewing the privacy policy of each of our third parties. For example, we use Google Analytics. You can find more information about how Google uses data when you use our partners' sites or apps at this link: https://policies.google.com/technologies/partner-sites.

You can see which cookies are third-party cookies by checking the “Details” column in the cookie banner. Our banner also provides links to their privacy policies or pages explaining how they process your data.

To help you understand the purpose of each cookie, we have classified each one as follows:

Necessary cookies

These cookies are necessary for our website to function and for you to navigate and use its features. For example, they help the website load quickly and efficiently, allow you to log in as a registered user, and ensure that your selected items and entered data are not lost as you move between pages during a browsing session. Without strictly necessary cookies, some features of our website will not work, and the website may not run as smoothly as it should. These cookies do not collect information for marketing purposes or track your activities on our website or elsewhere on the internet.

Performance or statistics cookies

Performance cookies collect information about how you use our website and help us improve how it works. For example, they can show which pages are visited most often, how long visitors spend on a page, and which articles they open, as well as help us identify any problems with a page. These cookies track your activity on our website, but they collect information in a way that does not directly identify you. Performance cookies do not collect information for marketing purposes or track your activities elsewhere on the internet.

Preference or functionality cookies

Functionality cookies support specific interactive features that provide added value to you, although our website can still function without them. They allow our website to remember you and the choices you make (such as your language or region) and provide enhanced, personalized features. For example, they can customize a particular website, provide other features you request (such as watching a video or leaving a comment), and remember whether you have visited our website before so that you are not shown messages intended for first-time visitors. Marketing and targeting cookies

Marketing cookies are used to track visitors across websites. The aim is to display ads that are relevant and engaging to individual users and therefore more valuable to publishers and third-party advertisers.

Targeting or advertising cookies are used to deliver ads that are more relevant to you and your interests, limit the number of times you see the same ad on a website, and measure the effectiveness of advertising campaigns by tracking your clicks.

Ads may not appear on our website; they may appear elsewhere even after you have closed our website. These cookies collect information for marketing purposes and track your activities not only on our website but also elsewhere on the internet.
